The Act provides for a wide range of circumstances that may warrant Ministerial intervention. These circumstances may include a medical report confirming the need for the ongoing care of an Australian citizen or permanent resident. This article considers some common circumstances that might warrant Ministerial intervention. Also, read our section on Unique and Exceptional circumstances. There are several ways to obtain such an intervention. These methods include:

Unique circumstances

Certain circumstances may justify the Minister of Immigration intervening in an immigration case. These circumstances are known as "unique circumstances", and are the basis of the Ministerial Guidelines. They describe what information the Minister must consider and how to submit them. While these Guidelines are not binding, they may guide the Minister's decision in certain cases. The Minister's intervention can be requested by a person who has received a decision from a review tribunal. In this case, the decision must have been made in the public interest.
